নিয়ম ও শর্তাবলি:

ক) পরিচিতি:

এই পেজটিতে প্রবেশের জন্য আপনাকে showstopper এর পক্ষ থেকে জানাই শুভেচ্ছা ও স্বাগতম। Showstopperbd.com একটি অনলাইন ভিত্তিক বানিজ্যিক কেন্দ্র। এবং এই শর্তগুলো হলো ওয়েবসাইটটিতে আপনার প্রবেশ ও Showstopper.com এর সম্পর্কিত তথ্য ব্যবহার ও তত্ত্বাবধান করার শর্তাবলী।

সাইটটি ব্যবহারের অর্থ হচ্ছে, আপনি আমাদের শর্তাবলি সম্পর্কে অবগত এবং এগুলো মেনে চলতে সম্মত ("ব্যবহারকারী" চুক্তি ")। তাই আপনি যদি সাইটের এই ব্যবহারিক চুক্তিতে সম্মত না হন তাহলেই সাইটটিতে অ্যাক্সেস, নিবন্ধন বা সাইটটি ব্যবহার থেকে বিরত থাকুন। এই সাইট পার্পেল কেয়ার লিমিটেডের মালিকানাধীন ও পরিচালিত, আইন ১৯৯৪ এর অধীনে গঠিত একটি সংস্থা।

কোন পূর্ব নোটিশ ছাড়াই সাইটটি যেকোন সময় এই শর্তাবলি পরিবর্তন (সংশোধন, সংযোজন বা অপসারণের অধিকার) ও সংরক্ষণ করার অধিকার রাখে। নতুন শর্তাবলি অনুযায়ী ওয়েবসাইটে পোস্ট শুরু হলেই পরিবর্তনটি কার্যকর হবে। সাইটে কোন পরিবর্তন পরিলক্ষিত হলে “নিয়ম ও শর্তাবলি” পেইজটি পড়ুন তাহলেই আপনার সকল জিজ্ঞাসার উত্তর পেয়ে যাবেন। সাইটটি ব্যবহারের নিয়ম ও শর্তাবলি পরিবর্তন করার পরে পরিবর্তিত নিয়ম অনুসারেই সাইটে সকল পোস্ট আপডেট করা হবে।

 

খ) ব্যবহারের শর্তাবলি

১। আপনার অ্যাকাউন্ট

ওয়েবসাইটে প্রদত্ত সকল পরিষেবা গ্রহণের জন্য আমাদের সাইটে একটি অ্যাকাউন্ট তৈরি করুন। অ্যাকাউন্ট তৈরি করতে ব্যক্তিগত কিছু তথ্য সরবরাহ করতে হবে। আমরা যদি কোন সাইট ব্যবহারকারীর দ্বারা কোন ধরনের ক্ষতির আশংকা অনুভব করি তাহলে আমাদের একক এবং সূক্ষ্ম বিবেচনায় কোন পূর্ব নোটিশ ছাড়া যেকোন সময় সেই ব্যবহারকারীর নাম এবং অ্যাকাউন্ট অথবা পাসওয়ার্ড অকার্যকর করতে পারি।

অনুগ্রহপূর্বক, আমাদের ওয়েবসাইটে আপনার ভিজিট পরিচালনা করতে আমাদের গোপনীয়তা চুক্তি (প্রাইভেসি পলিসি) সেকশনটি পর্যালোচনা করুন। আপনার দ্বারা বা আপনার ব্যবহারের মাধ্যমে আমাদের সাইটে সরবরাহকৃত আপনার সকল ব্যক্তিগত তথ্য / ডেটা গোপনীয়তা চুক্তি আইন ও বিধিমালা অনুসারে কঠোরভাবে গোপনীয় হিসাবে বিবেচিত হবে। যদি আমাদের গোপনীয়তা চুক্তিতে বর্ণিত বিধিমালা মানতে অসম্মতি প্রকাশ করেন তাহলে সাইটটি ব্যবহার না করার অনুরোধ জানানো হচ্ছে।

 

আপনার পরিচয়, পাসওয়ার্ড, অ্যাকাউন্টের বিশদ বিবরণ এবং এ সম্পর্কিত যেকোন ব্যক্তিগত তথ্যের দায়বদ্ধতা আপনার। আপনার অ্যাকাউন্ট ও এ সম্পর্কিত সকল তথ্যের সত্যতা সম্পর্কে যদি আপনি সুনিশ্চিত থাকেন তাহলে এর সুরক্ষিত রক্ষণাবেক্ষণের দায়িত্ব আমাদের এবং আপনার অ্যাকাউন্টের অপব্যবহার রোধে সমস্ত পদক্ষেপ গ্রহণ করা হবে।

আপনার পাসওয়ার্ড অন্য কেউ জেনে গেছে বা যদি পাসওয়ার্ডটি অননুমোদিতভাবে ব্যবহার করা হয় বা হওয়ার সম্ভাবনা থাকে তাহলে অবিলম্বে তা আমাদের জানান। ওয়েবসাইটের পরিষেবাগুলোর সকল ব্যবহার এবং আপনার অ্যাকাউন্ট এবং পাসওয়ার্ড ব্যবহার করে ব্যক্তিগত তথ্য, ডেটা বা যোগাযোগের সকল অ্যাক্সেস আপনার দ্বারা সম্পাদিত বা আপনার দ্বারা অনুমোদিত এই বিষয়ে আপনাকে সম্মত থাকতে হবে। সাইটের সকল অ্যাক্সেস অথবা সাইটে প্রস্তাবিত সকল পরিষেবা (যেমনঃ অ্যাক্সেস বা ব্যবহার আপনার দ্বারা অনুমোদিত হোক না কেন) আপনিই গ্রহণ করেছেন এই বিষয়ে সম্মতি প্রদান করতে হবে। আপনার যেকোন তথ্য সম্পাদিত বা সঞ্চারিত হয়েছে এমনভাবে আচরণের আপনি দায়বদ্ধ থাকবেন। আপনার অ্যাকাউন্টের মাধ্যমে সাইটের ব্যবহার বা অ্যাক্সেস এর কারণে যেকোন ক্ষতির বিরুদ্ধে আপনি আমাদের সম্পূর্ণ ক্ষতিপূরণ দিতে বাধ্য এবং সম্মত হবেন।

 

অনুগ্রহপূর্বক নিশ্চিত করুন যে, আপনি আমাদের যে তথ্য সরবরাহ করেছেন তা সঠিক। কেননা আপনার অ্যাকাউন্টটি অনলাইনে অ্যাক্সেস করে রিয়েল টাইমে আপনার অ্যাকাউন্ট পুরোপুরি আপডেট করা হলে সেই তথ্যের দায়বদ্ধতা আপনার। পরবর্তীতে তথ্যগুলো আপডেট করতে আপনাকে আমাদের গ্রাহক পরিষেবা যোগাযোগ চ্যানেলগুলোতে অবহিত করতে হবে। কোন পূর্ব নোটিশ ছাড়াই যেকোন সময় সাইটে অ্যাক্সেস প্রত্যাখ্যান, অ্যাকাউন্টগুলো বন্ধ করা, সামগ্রিক অপসারণ বা সম্পাদনা করার অধিকার আমরা সংরক্ষণ করি। আপনি যদি ব্যক্তিগত সুরক্ষার স্বার্থে যেকোন সময় ব্যক্তিগত তথ্য আপডেট করেন অথবা তাৎক্ষনিকভাবে কোন কারণ বা পূর্ব নোটিশ না দিয়ে অ্যাকাউন্ট বা এ সম্পর্কিত বিষয়াদি অকার্যকর করেন তাহলে আপনার দ্বারা ওয়েবসাইট ক্ষতিগ্রস্থ হওয়ার সম্ভাবনা থাকলে বা ক্ষতিগ্রস্থ হলে তার দায়বদ্ধতা আপনার থাকবে না। আপনি এখানে যেকোন সময় নিজের পাসওয়ার্ড পরিবর্তন করে আপনার অ্যাকাউন্টটি সুরক্ষিত রাখতে পারবেন এবং আপনার অ্যাকাউন্টের গোপনীয়তার জন্য এবং আপনার ব্যবহারকারীর নাম এবং ঠিকান অথবা পাসওয়ার্ড এর কোন প্রকাশ বা ব্যবহারের জন্য দায়বদ্ধ থাকবেন।

২। আপনার অ্যাকাউন্ট বনাম অর্ডার

যদি showstopperbd.com এর ওয়েবসাইট অ্যাকাউন্ট থেকে অর্ডার প্লেস করা হয় তাহলে আমরা সেই অ্যাকাউন্ট হোল্ডারকে ক্লায়েন্ট হিসেবে বিবেচনা করি

showstopperbd.com যেকোন সময় আপনার অ্যাকাউন্ট বাতিল/অকার্যকর/স্থগিত/চালু করার অধিকার রাখে। আপনার অ্যাকাউন্ট ব্লক/ব্যান হয়ে গেলে showstopperbd.com আপনাকে কোন প্রকার অর্থ প্রদান করতে বাধ্য নয়। বিকাশ/ব্যাংক/ক্যাশ এর মাধ্যমে পেমেন্ট করা অর্থ নির্দিষ্ট সময় পর যাচাই বাছাই শেষে ফেরত দেওয়া হবে। আপনার টোটাল পেমেন্ট ও ক্যাশব্যাক প্রাপ্ত অর্থ ব্যবহারের পর উদ্ধৃত অর্থই আপনি ফেরত পাবেন।

৩।আচরণবিধি:

ওয়েবসাইটটি আপনি এমন কোন কাজে ব্যবহার করতে পারবেন না যেটি আমাদের বা অন্যকোনো পক্ষের জন্য ক্ষতির কারণ হতে পারে। যদি এমনটা হয় তাহলে আপনাকে ওয়েবসাইট ব্যবহারে রেস্ট্রিক্টেড বা বিরত রাখা হবে ।

প্রতারণামূলক উদ্দেশ্যে বা কোন ফৌজদারি অপরাধ বা অন্য বেআইনী কার্যকলাপের সাথে সম্পর্কিত, আপনার নিজস্ব নয় এমন কোন তথ্য প্রেরণ, ব্যবহার বা একই তথ্য পুনরায় ব্যবহার করা; বা অবৈধ, আপত্তিকর (যৌন বিষয়বস্তুযুক্ত সামগ্রী বা বর্ণবাদ, ধর্মান্ধতা, ঘৃণা বা শারীরিক ক্ষতি প্রচার করে এমন উপাদানসহ), প্রতারণা, বিভ্রান্তিকর, আপত্তিজনক, অশালীন, হয়রানি, নিন্দা, মানহানি, অবমাননাকর, অশ্লীল, প্যাডোফিলিক বা মেনাকিং; জাতিগতভাবে আপত্তিজনক, আপত্তিকর বা কপিরাইট, ট্রেডমার্ক, গোপনীয়তা, গোপনীয়তা বা অন্যকোন মালিকানা সম্পর্কিত তথ্য বা অধিকার লঙ্ঘন; বা অন্যথায় তৃতীয় পক্ষের জন্য ক্ষতিকারক; বা অর্থ লন্ডারিং বা জুয়া সম্পর্কিত বা প্রচার করা; বা কোনভাবে নাবালকের পক্ষে ক্ষতিকারক; বা অন্য ব্যক্তির ছদ্মবেশ ধারণ করে; বা বাংলাদেশের ঐক্য, অখণ্ডতা, সুরক্ষা বা সার্বভৌমত্ব বা বিদেশী রাষ্ট্রগুলির সাথে বন্ধুত্বপূর্ণ সম্পর্কের হুমকি দেয়; বা আপত্তিজনক বা অন্যথায় যেকোন উপায়ে বেআইনী আচরণ পুরোপুরি অগ্রহণযোগ্য।

 নিম্নোক্ত আচরনগুলো সাইটটির অবৈধ ব্যবহার বলে গণ্য হবে-

বিরক্তি, অসুবিধা বা অযথা উদ্বেগ সৃষ্টি করলে

আমাদের নিয়মের বহির্ভূত কোন আচরণ করলে

৪। সাবমিশন:

সাইটে জমা দেওয়া অথবা আমাদের কাছে সরবরাহকৃত তথ্য, পর্যালোচনা, মন্তব্য এবং পরামর্শগুলোর কোন সীমাবদ্ধ নেই তবে তা আমাদের একমাত্র এবং একচেটিয়া সম্পত্তি বলে গণ্য হবে এবং আপনি তা বাতিল করতে পারবেন না। যেকোন তথ্য ও মন্তব্য সাইটে জমা দেওয়ার সাথে সাথে সেইটা আপনার পরিচয়ে গণ্য হবে। আপনি কোন মিথ্যা ই-মেইল, ঠিকানা ব্যবহার করবেন না, নিজ পরিচয় ব্যতীত অন্যকারো পরিচয় ব্যবহার করবেন না বা এমন কোন তথ্য জমা দিবেন না যা তৃতীয় পক্ষকে বিভ্রান্ত করবে। কোন সাবমিশন বিভ্রান্তিকর মনে হলে কোন ধরনের আইনি নোটিশ অথবা নোটিফিকেশন ছাড়াই আমরা তা বদলিয়ে বা সরিয়ে ফেলার অধিকার রাখি।

৫। ক্ষতি

আমাদের কোন ব্যবসায়িক বা ব্যক্তিগত ক্ষতি (আয়, চুক্তি, পূর্বাভাসিত বিনিয়োগ তহবিল, তথ্য, পরার্থপরতা, বা অপব্যবহারে সীমাবদ্ধ নয়) বা কোন পরোক্ষ কোন ক্ষতি যা আপনার বা আমাদের অনুমানযোগ্য বা নিয়ন্ত্রণাধীন ছিলোনা এমন কোন বিষয়ে জবাবদিহি করতে বাধ্য নয়।

৬। শর্তের সংশোধন বা পরিষেবার পরিবর্তন এবং এ সম্পর্কিত প্রতিশ্রুতি

সাইটে যেকোন ধরনের পরিবর্তন (কৌশল, নিয়ম ও শর্তাবলি অথবা নিয়মাবলি, প্রশাসনিক টার্ম ইত্যাদি) করার সম্পূর্ণ অধিকার আমরা রাখি। আপনি সাইটটি ব্যবহার করার সময় শর্তাবলি অবশ্যই পালন করবেন তবে সরকার বা আইন বিশেষজ্ঞ দ্বারা কোন কৌশল পরিবর্তিত হলে আমরা সেইটা পরিবর্তন করার অধিকার রাখি। নতুন শর্তাবলি আপডেট করার পর আপনি পূর্বের শর্তাবলি ব্যবহার করতে পারবেন না। এবং যে ইভেন্ট বা ফর্মে পূর্বের নিয়ম বা শর্তগুলো ব্যবহৃত হয়েছে সেইটা অবৈধ ও অকার্যকর বলে বিবেচিত হবে.।

৭। ওয়েভার বা স্বত্বত্যাগ

আশা করি বুঝতে পেরেছেন, আমরা একটি ব্যক্তিগত ব্যবসায়িক প্রতিষ্ঠান এবং আমরা আমাদের সুবিধা অনুযায়ী ব্যবসায়ী রীতি পরিবর্তন ও পরিবর্ধন করে থাকি। আপনি যদি আমাদের নিয়ম ভঙ্গ করেন এবং আমরা তৎক্ষণাৎ কোন পদক্ষেপ না নিয়ে থাকি তাহলে জানবেন, আপনি আমাদের বিশেষ সুবিধাগুলো গ্রহণের যোগ্যতা রাখেন।

৮। আইন ও বিচার বিভাগ পরিচালনা করা

এই শর্তাবলি গণপ্রজাতন্ত্রী বাংলাদেশের আইন অনুসারে প্রস্তাবিত ও পরিচালিত। এই সকল নিয়মাবলি ও চুক্তি নিয়ে যেকোন ধরনের অভিযোগ বা আইনি সমাধানের জন্য বাংলাদেশের আইন ও  ঢাকাস্থ সকল আদালত, কাউন্সিল এবং অতিরিক্ত আধা-আইনি সংস্থাগুলির অধীনস্থ হতে পারবেন। 

৯। অফার:

showstopperbd.com  এই ওয়েবসাইটে প্রস্তাবিত অফারগুলো ছাড়া, অন্য কোন স্থান/সাইটে, ব্যবসায়ী/আমদানিকারক/বিক্রেতা কোন ধরনের অফার প্রদান অধিকার রাখে না। আপনি যদি কোন অফার চান তাহলে আমাদের পেজ এবং ফোন নাম্বারে অনুরোধ/জিজ্ঞাসা/মতামত জানার চেস্টা করতে পারেন অথবা showstopperbd.com  ওয়েবসাইটে প্রদত্ত/ঘোষিত অফার সম্পর্কিত ডেটা খুঁজে বের করতে পারেন।যেকোন স্পেশাল অফার চলাকালীন একজন ক্লায়েন্ট একাধিক অর্ডার করতে পারবেন।কাস্টমার showstopperbd.com ছাড়া অন্যকোন মাধ্যম (যেমন: বিকাশ, ব্যাংক অথবা ক্যাশ) থেকে ক্যাশব্যাক গ্রহণ করবে না। একটি অর্ডারে একাধিক অফার গ্রহণযোগ্য হবে না। অন্যান্য অফার উপভোগ করতে নতুন অর্ডার করতে হবে। 

১০। মূল্যায়ন, প্রাপ্যতা এবং অর্ডার প্রক্রিয়াকরণ

সকল পণ্যের মূল্য বাংলাদেশী টাকায় (BDT) নির্ধারিত করা হয়েছে এবং ভ্যাট সংক্রান্ত তথ্য ও ক্রয়-বিক্রয়ের সকল রেকর্ড ওয়েবসাইটে নথিভুক্ত রয়েছে। মূল পেইজে দেখানো সর্বশেষ মূল্যটিই আপনার শপিং কার্টে থাকা পণ্যটি / পণ্যগুলো সঠিক মূল্য হিসেবে বিবেচিত হবে। পণ্যের দাম পরিবর্তন হওয়ার পূর্বে আপনি যদি পণ্যটি কার্টে অ্যাড করে থাকেন সেক্ষেত্রে পণ্যের মান পরিবর্তন হবে। তাই অনুগ্রহপূর্বক পণ্যটি কেনার আগে পণ্যের দামটি দেখে নিবেন।আমরা আমাদের সাইট অথবা ভিন্ন কোন সাইট থেকে বিক্রিত কোন পণ্যের দাম সমন্বয় করিনা।

আমরা ক্লায়েন্টদেরকে সর্বোচ্চ সঠিক ডেটা দিতে সংকল্পবদ্ধ; তবে টেকনিক্যাল সমস্যার কারণে যেকোন ধরনের বিপত্তি ঘটলে (যেমনঃ পণ্যের মূল্য ওয়েবসাইটে ঠিকঠাক দেখাচ্ছে না) আমরা যেকোন অর্ডার বা অর্ডার রিকোয়েস্ট বাতিল করার অধিকার রাখি। যদি কোন পণ্যের মূল্য ভুল দেখানো হয়, আমরা আমাদের ত্রুটি এবং নির্দেশিকাগুলো পর্যালোচনা করে আপনার সাথে যোগাযোগ করবো বা আপনার অর্ডার বাদ দেওয়ার অনুরোধটি গ্রহণ করবো। তবে আপনার অনুরোধটি নিশ্চিত করার পূর্বে প্রিপেমেন্ট পরিচালনা করা হয়ে গেলে অর্ডার বাতিলের কোন অপশন ওয়েবসাইটে দেখানো হয়না। এক্ষেত্রে পণ্যটির মূল্য প্রিপেইড করা হয়ে গেলে আমরা গ্রাহককে ডিসকাউন্টের সুবিধা প্রদান করে থাকি। মনে রাখবেন, যেকোন ডিসকাউন্টের পরিমাণ ও মূল্য নির্ধারণের সম্পূর্ণ ক্ষমতা রাখে। সাধারনত, ডিসকাউন্টের পরিমাণ নির্ধারিত হয় ক্লায়েন্ট আমাদের ওয়েবসাইট থেকে কী পরিমাণ কেনাকাটা করে তার উপর।

আপনার অর্ডারটি ক্যান্সেল হলে তা ফোন বা এসএমএসের মাধ্যমে জানিয়ে দেওয়া হবে। ওয়েবসাইটের সকল পণ্যের সঠিক রেকর্ড রাখার জন্য আমরা পণ্যগুলোর অ্যাক্সেসিবিলিটি ডেটা তালিকাভুক্ত করে থাকি, যেন প্রতিটি পণ্যের সঠিক ডেটা পেইজে আপডেটেড থাকে। এবং পণ্য সংক্রান্ত যেকোন তথ্য ডেটা অনুযায়ী প্রদান করা হয়ে থাকে। তাই বাতিল হওয়া পণ্য অর্ডার করার সাথে সাথেই ওয়েবসাইট থেকে সরিয়ে নেওয়া হয়। ফলে পণ্যটির স্টক শেষ হয়ে গেলে সেইটা রিস্টক করা পর্যন্ত পণ্যটি অর্ডার করা সম্ভব নয়।

আপনাকে অবগত করা হচ্ছে যে, বিভিন্ন কারণে আপনার রিফান্ড রিকোয়েস্টটি রেডি হতে সমস্যা হতে পারে। আমরা রিকোয়েস্টটি অ্যাক্সেপ্ট করার পূর্বে আপনার কাছে অতিরিক্ত নিশ্চিতকরণের জন্য কোন ফোন, এসএমএস বা ডেটা প্রেরণ করা হতে পারে। কর্তৃপক্ষ তার সুবিধার্থে যেকোন সময় যেকোন ধরনের অনুরোধ বা নিয়ম পরিবর্তন বা বাদ দেওয়ার অধিকার রাখে।

ক্রেডিট কার্ড বা চেকবুক সংক্রান্ত জালিয়াতি রোধে, আপনাকে কোন পণ্য প্রেরণ করার আগে ইন্সটলমেন্টের সত্যতা যাচাই করতে আমরা আপনার সাথে বিভিন্নভাবে যোগাযোগ করতে পারি। এই নিশ্চিতকরণ প্রক্রিয়াটি আপনাকে সরাসরি করতে হতে পারে অথবা আমরা আপনার ঠিকানা বা ব্যাঙ্কিং ডেটার সত্যতা যাচাই করতে পারি। এই প্রক্রিয়ায় যদি কোন তথ্য ভুল পাওয়া যায় তাহলে আপনার রিকোয়েস্টটি প্রসেস হবেনা। কর্তৃপক্ষ যদি ব্যাংকিং প্রসেসটি ঝুঁকিপূর্ণ মনে করে তাহলে যেকোন সময়, কোন ধরনের পূর্ব নোটিশ ছাড়াই তা বাতিল করার সক্ষমতা রাখে।

কোন পণ্যের মূল্য নির্ধারণের ক্ষেত্রে যদি কোন ভুল পাওয়া যায় (যেমনঃ MRP-এর চেয়ে বেশি বা MRP-এর চেয়ে কম দাম) এবং যদি বিক্রেতা সেই ভুল মূল্যের পণ্য সরবরাহ করে তাহলে আমাদেরকে অভিযোগটি জানান। অভিযোগটি জানানোর পরেও যদি তা সমাধান না হয় তাহলে তার দায়বদ্ধতা বিক্রেতার এবং তার বিরুদ্ধে আইনি ব্যবস্থা নিতে পারবেন।

১১। স্পেশাল আইটেমস

নিরাপত্তা এবং জালিয়াতি

আপনি যখন কোন ভাউচার ব্যবহার করবেন, তখন খেয়াল রাখবেন যে, আপনি যথাযথভাবে সেটির ব্যবহার করছেন।

যদি কোন ধরনের ক্ষতির আশংকা থেকে আপনার অ্যাকাউন্টটি বাতিল করা হয় এবং পরবর্তীতে তা ভুল প্রমাণিত হয় এবং আপনি অ্যাকাউন্টটি ফিরে পান তাহলে আপনার ভাউচারটিও পুনরুদ্ধারিত হবে।

আপনি যদি স্বজ্ঞানে স্বীকার করেন, আপনার ভাউচারটি কোন বেআইনি কাজে ব্যবহৃত হয়েছে তাহলে আমরা আপনার পরবর্তী সকল ভাউচার ক্যান্সেল করার অধিকার রাখি।

১২। একাধিক কেনাকাটা
